Terms of Service.
These Terms & Conditions govern your use of the services provided by Kingston Enterprises, Inc dba Just By Design (“we”, “us”, or “our”). By accessing or using our website and engaging our services, you agree to be bound by these terms.
01SMS Program Terms
Business Identity
We send appointment-related notifications to customers who have booked with Kingston Enterprises, Inc. (dba Just By Design) and opted in to receive SMS messages. Messages include appointment confirmations, reminders, updates, and rescheduling notices. Customers provide explicit consent on our website forms or chat widget prior to receiving these notifications. Message frequency varies. Reply STOP to unsubscribe.
Opt-Out & Support
You can cancel the SMS service at any time. Just text “STOP” to 541.526.3406. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Message Frequency
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive under 3 messages per day. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Age Restriction
You must be 18 years or older to opt in to receive SMS communications from Kingston Enterprises, Inc (dba Just By Design).

02Services & Deliverables
We provide marketing, branding, website design, content strategy, and digital services customized for each client. A detailed scope of work will be outlined in your project proposal or agreement.
03Intellectual Property
Unless otherwise agreed, all original design, code, and content created by Just By Design remain our intellectual property until full payment is received. Final deliverables are transferred to the client for use in their business, but may not be resold or repurposed without written consent.
04Payment Terms
Invoices are due within the terms specified on your proposal or invoice. Late payments may result in project delays or additional fees.
05Client Responsibilities
Clients are expected to provide timely feedback, approvals, and materials. Delays in communication or deliverables may impact project timelines.
06Termination & Cancellation
Either party may terminate a project in writing. Completed work and time invested will be billed accordingly. Unused deposits may not be refundable.
07Limitation of Liability
Just By Design is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.
08Indemnification
Clients agree to hold Just By Design harmless against any claims, losses, or liabilities arising from use of our work in violation of applicable laws or third-party rights.
09Governing Law
These terms shall be governed by the laws of the State of Oregon. Any disputes will be handled in the appropriate jurisdiction within Oregon.
10Changes to Terms
We may update these terms from time to time. Clients will be notified via email or site notice of any material changes.
